About Us

Exclusive Live, LLC operates a software platform located on the Chaturbate website (hereinafter referred to as the "Platform").

Information That We May Collect and Process About You

• Information that you provide to us, including, by way of example only, your username, email address, date of birth, as well as images and content that you may share, including content related to age verification.
• Your IP address.
• Information relating to the accounts you have visited and the products and services you have clicked on or expressed interest in.
• Information, messages, and content that you share through your account.
• Information, messages, and content saved through your account.
• Information provided by other companies that have received your permission to share information about you under their privacy policy.
• Information about your interaction with the Platform, including any advertisements.
• Information that we collect through cookies stored on your device about your use of the Platform and/or selected third-party websites.
• Information that we collect or remember using technologies similar to cookies, such as device identifiers on your mobile device.
• Technical information from your device relating to the services you receive and/or access.
• Your communications with billing and support staff.
• Information relating to your device's location.

How We May Use Your Information

General Site Administration

By accessing the Platform, you agree that we may collect, store, use, and otherwise process your content, data, messages, and information (including personal information) in order to provide you with the products and services that you request and/or access, as well as to develop and operate our business. By providing us with your email address, you agree to receive emails from us, or sent on our behalf, containing messages related to your account, including, but not limited to, purchase confirmations, renewals, warnings, alerts (including alerts related to user streaming or content submissions), and newsletters. If you choose to provide an email address, you can change it at any time.

Payment Processing

Please note that we contract with various third parties to process payments in connection with any purchases you may make through the Platform. The processing and storage of any information that you may provide to any third-party payment processor, including information that they may receive from you, is not governed by this Policy. You should review the Privacy and Cookie Policy of such third parties on their website.

Fraud Prevention Services

We use third-party services in connection with the prevention of fraud and other harm to the Platform and its systems. Accordingly, we may provide such services using your IP address and device access data to detect and prevent potential fraudulent or other improper activities that may harm the Platform and/or its users. This information will be retained indefinitely to protect the Platform and its users.

Content Safety

All content, whether written, streamed live, recorded through photographs, or otherwise, is subject to automatic or manual review to ensure that all such content complies with the ExcluLive terms. Individuals who broadcast and prefer not to show their face, including, for example, by wearing a mask or broadcasting only from a limited point of view, may periodically be interrupted with a request to take a selfie to confirm that they are of legal age (as defined in the Terms). These images are stored as part of the age verification records for review by our qualified age verification team.

Registration Information and How It Is Used

General Account Registration: You will be required to provide a username and date of birth to demonstrate that you meet the minimum age requirements set out in the Terms and Conditions, which are maintained internally for the purposes of account access. You will also be required to provide certain information that will be posted in your bio and is considered publicly available, including the age shown on your bio page (please note that this does not have to be your real age, provided that you do not use the age feature to suggest that you accessed the Platform before reaching the desired age). This includes your age of majority and gender information, including your gender (which may be updated as necessary, provided that it is not used for offensive purposes), as well as information about the gender of the people you are interested in communicating with. This information, as well as any information you choose to provide in your account profile (including, by way of example only, your location and other optional details such as "about me" and any wish lists), will be published publicly in connection with your username and is considered publicly available information, as described below, regardless of whether a password is used on your profile.

Independent Broadcaster Registration: In addition to the general account registration information listed above, you will be required, as described in more detail below, to provide a color copy of your current government-issued photo identification, as well as a short live video and/or a series of photographs of yourself. We retain this information in accordance with United States federal law, which, as of the date of this Policy, requires that all age verification documents and images be retained for seven (7) years from the date the content was last accessible through your account. If you choose not to work with a studio, you will be required to provide information such as a bank account or home address before you can receive payment. If you decide that someone else will receive the payment (for example, a business or romantic partner), that person will also be required to provide age verification information through your account. You may be required to provide certain taxpayer information. We report to the Internal Revenue Service of the United States, and to similar services/agencies of any foreign countries as we may deem necessary or appropriate, all funds paid through the Platform to independent broadcasters.

Independent Partners: If you choose to create an independent advertising partner account on the Platform, you will be required to provide information such as a bank account or home address. You may be required to provide certain taxpayer and age verification information, including completing the age verification procedure required of independent broadcasters. We report to the Internal Revenue Service of the United States, and to similar services/agencies of any foreign countries as we may deem necessary or appropriate, all funds paid through the Platform to independent broadcasters.

Public Information

The Platform may provide bulletin boards, blogs, chat, private/direct messages, tip notes, content streaming, image sharing, and other capabilities for creating user-generated content in addition to user profiles. Anything you share through any of these means is considered public information, regardless of whether you use a password or any other feature to restrict its visibility to other users. You should always exercise caution when deciding whether to disclose your personal information. All public information is subject to review and monitoring for compliance with the ExcluLive terms. In addition, as stated in the Terms, we would like to remind you to exercise caution when sharing links and means of contact outside the Platform, because:

• 1. Sharing such information may, intentionally or unintentionally, lead to the disclosure of personally identifiable information.
• 2. With very rare exceptions, we are unable to assist with such links and messages, as we cannot verify any alleged screenshots provided to us. When you purchase tokens and tip other independent broadcasters, and/or when you purchase a Platform subscription or fan club membership, the color of your username may change depending on such activity.
